Art. 1 Nature of the Object
By this agreement, the Artist entrusts L’Abeille Blanche with the consignment sale of the products defined at the time of deposit.
Art. 2 Consignment Procedure
Each party indicates its agreement by signing this contract after reading and accepting these general terms and conditions of consignment sale.After agreement, the Artist must deliver the product defined in Article 1 (“Nature of the Object”) either in person or by post, at their own expense, to L’Abeille Blanche at the following address:Rue des Brasseurs 9, 1000 Brussels, Belgium,within a maximum of 5 working days.
Art. 3 Duration / Termination of the Contract
This contract takes effect on the date of its signature and is concluded for an indefinite period.
A trial period of 3 months is established at the start of the contract. At the end of this period, L’Abeille Blanche may terminate the agreement with immediate effect.
Beyond the trial period, either party may terminate the contract by giving two weeks’ notice.
In the event of termination or expiration of the contract, the Artist shall have one (1) month to collect their products from the shop.After this period, if the Artist has not retrieved their items, L’Abeille Blanche may consider them abandoned, and the Artist thereby waives any claim to restitution.
Return shipping costs are the responsibility of the owner if they do not collect the item in person.
Art. 4 Regulations
The Artist authorizes L’Abeille Blanche to sell the product presented in the contract by displaying it in the exhibition space. The Artist also authorizes the website labeilleblanche.com to sell the product online, as well as through various distribution channels such as Instagram, Google, Facebook, etc.
L’Abeille Blanche ensures the safekeeping and conservation of the Artist’s items at the ASBL’s address, as stated in Article 2 (“Consignment Procedure”).
Art. 5 Consignment Sale
The items sold by L’Abeille Blanche come from private individuals or professionals who use the ASBL’s services to sell their products.The ASBL acts as an intermediary between the seller and the buyer and cannot be held responsible for any misconduct or fraud committed by the Artist.
L’Abeille Blanche will cancel the sale of a product if it has not yet been finalized.
In the event of a hidden defect, the buyer may take legal action directly against the Artist before the competent court, excluding L’Abeille Blanche from any liability.
L’Abeille Blanche reserves the right to withdraw from sale, without notice or compensation, any item found to have a structural or functional defect not declared at the time of signature, rendering it unfit for sale under L’Abeille Blanche’s quality standards.
This rule also applies to any item whose ownership appears doubtful.
Return costs remain the responsibility of the owner if they do not collect the item in person.
No transfer of ownership takes place between L’Abeille Blanche and the Artist. Ownership is transferred directly between the Artist and the buyer once the sale is concluded.
Art. 6 Mandate
The Artist grants L’Abeille Blanche a non-exclusive mandate to sell, on their behalf, the product described in this contract.
All cash transactions are managed by L’Abeille Blanche.
The Artist is responsible for all their sales and must pay all applicable taxes.
L’Abeille Blanche will charge the Artist an intermediary fee of 30% (including VAT at 21%) on all sales.
L’Abeille Blanche reserves the right to select the items it accepts for sale and is under no obligation to accept all items submitted, particularly those with excessively high prices or costly handling requirements.
L’Abeille Blanche also reserves the right to refuse any item that does not comply with current legislation or with the regulations of the sales platforms used as distribution channels.
Unless otherwise agreed, advertising costs are borne by L’Abeille Blanche, while shipping costs are borne by the buyer.Products are listed for sale without any advertising, listing, or administrative fees for the Artist, even on external platforms not owned by L’Abeille Blanche.
The Artist authorizes L’Abeille Blanche to take photos and videos of the product, edit, publish, store, and use them commercially.All image rights remain the exclusive property of L’Abeille Blanche.
The Artist authorizes L’Abeille Blanche to calculate transport volume and costs for shipments.
Products will be listed on sales platforms exclusively chosen by L’Abeille Blanche.
Art. 7 Sale Price
The agreed sale price of the consigned product is listed in the SumUp register and verified by the Artist at the time of deposit.
The sale price at L’Abeille Blanche cannot exceed the price of the same product if sold directly by the Artist through their own channels (website, store, market stand, etc.).
Art. 8 Disputes – Liability – Theft
L’Abeille Blanche undertakes to sell only certified authentic products.However, the ASBL cannot be held responsible for the quality or functioning of items sold on behalf of third parties.The Artist remains solely responsible beyond the 14-day legal period covered by L’Abeille Blanche for online sales, in accordance with our General Terms and Conditions of Sale.
If a dispute results in the cancellation of a sale by L’Abeille Blanche, the commission already paid remains fully due as compensation for the execution of its mandate.
The ASBL cannot be held liable for theft of products under any circumstances.The Artist may install anti-theft devices for their items, provided they do not interfere with other artists’ installations. Such devices must be installed by the Artist at their own expense.
Art. 9 Jurisdiction
The Commercial Court of Brussels-Capital shall have sole jurisdiction over any dispute.
Art. 10 Ownership of Goods
The Artist declares that all consigned items are their property and are not pledged or encumbered.
Art. 11 Sales Status
The Artist may request, at any time, an update on their previous month’s sales by email from Tuesday to Sunday between 10:30 AM and 6:30 PM (excluding public holidays).
Art. 12 Payment of Completed Sales
L’Abeille Blanche will transfer to the Artist’s account the total gross revenue (including VAT), after deducting the 30% commission owed to L’Abeille Blanche.Payments are made at the end of each month or according to another agreement made between the Artist and L’Abeille Blanche.
Art. 13 Shipping
In the case of online sales, L’Abeille Blanche handles packaging and shipment of items on behalf of the Artist.
Art. 14 Abandonment of Items
If the Artist does not respond to any communication from L’Abeille Blanche for a period of one (1) month, their items will be considered abandoned. In this case, L’Abeille Blanche becomes the rightful owner and may dispose of them freely (sale, donation, destruction, etc.) without any possible claim by the Artist.
Art. 15 Guarantee
L’Abeille Blanche guarantees the safekeeping of consigned items. It also guarantees payment of the Artist’s revenue as specified in Article 12.L’Abeille Blanche acts as the Artist’s agent, and sales are carried out under its responsibility.
Art. 16 Fire Insurance
L’Abeille Blanche insures all consigned items against fire risks and waives any claim against the Artist, except in cases of arson caused intentionally by the Artist.
