Tattoo artist contract

Use of a coworking space for tattoo artists

Between

L’Abeille Blanche ASBL, whose registered office is located at Rue des Brasseurs 9, 1000 Brussels, company number BCE 0769.976.003,

represented by Marcus Rubin and Jonathan Cousinne, administrators of the association,

hereinafter referred to as “the Association”,

and the tattoo artist signing this contract,

Art. 1 – Purpose

The Association provides the artist with a dedicated workspace at Rue des Brasseurs 9, 1000 Brussels, for the purpose of performing tattooing services. The tattoo area includes five workstations equipped with all the necessary materials, except for the tattoo machine itself.

It should be noted that the Association provides equipment suitable for the use of a rotary machine or for hand-poke tattooing. The studio is not equipped for coil machines.

Art. 2 – Access to the workspace and bookings

The shop is open from Tuesday to Sunday, from 10:30 a.m. to 6:30 p.m., except on public holidays or in exceptional circumstances.

Any exceptional closure of the shop will be communicated to the artist as early as possible.

The artist manages their own appointment schedule. A shared booking calendar is made available so the artist can reserve a workstation.

The artist must ensure that there is space available before making a reservation (a maximum of five simultaneous bookings). They must also reserve a sufficient time slot to complete the tattoo within the shop’s opening hours.

The artist may not move or cancel another artist’s appointments under any circumstances. If the artist has not made a reservation and all workstations are already booked, they must either postpone their appointment or wait until a station becomes available. The same applies if the artist did not reserve enough time to finish a tattoo: they must stop and continue the session at a later date.

In order to participate in walk-ins, the artist must demonstrate a sufficient level of tattooing quality.

Participation in the monthly flash days organized by the Association is only permitted after validation for walk-ins and active participation in the shop’s community life.

Only the management of the Association may grant permission for an artist to take part in walk-ins and flash days.

Art. 3 – Workspace and equipment

L’Abeille Blanche provides all consumables and furniture necessary for the artist to carry out their work (see Art. 1).

The artist must clean and disinfect their workspace and empty their bin after each tattoo.

The artist must respect the premises and the equipment provided (computer, printer, etc.) and notify the Association in case of any issue or malfunction.

The artist uses their own tattoo machine and all related accessories.

Personal machines or materials may not be left in the common space unless expressly agreed upon with the Association and the other artists, for a limited period defined by that agreement.

If the artist wishes to use their own consumables, they must obtain prior authorization from the Association. The use of personal consumables is at their own expense. Even when using their own materials, the Association’s commission remains due in full.

Any damage caused by the artist to shared equipment or the studio must be repaired or replaced by the artist, with equal or higher quality materials, at their own expense, within two weeks from the date of the incident.

Art. 4 – Sales

The Association uses a standard pricing scale for flash tattoos displayed in the shop. For personal projects or larger flash designs, the artist is free to set their own prices.

All sales are processed by the Association. Therefore, the artist must accompany the client to the shop’s front desk after each tattoo, where they will communicate the tattoo price to the person in charge.

The Association takes a 30% commission on the total price of each tattoo (any deposit previously paid directly to the artist will be added to the final total).

The Association collects its 30% share, payable in cash, by card, or via Payconiq by the client.

The artist directly collects their 70% share, payable in cash, by card, or via Payconiq. If the client wishes to pay by card, the artist must have their own payment terminal. Under no circumstances will the Association collect the artist’s portion of the payment.

Art. 5 – Duration of the contract

This contract takes effect on the date specified within and remains valid for an indefinite duration.

The artist must remain proactive and present at the shop. After a period of three (3) consecutive months of unjustified absence, the artist will be removed from the Association’s list of resident artists. To return, they must submit a new application, which the Association reserves the right to refuse.

Art. 6 – Guest work

The artist may work as a guest in another studio or participate in conventions, provided they notify the Association at least two (2) weeks in advance.

Art. 7 – Copyright

The artist retains full copyright over their creations and agrees not to reproduce or steal the work of others.

Art. 8 – Advertising and social media

The artist authorizes L’Abeille Blanche to take photos and videos of their work, to edit such images, and to publish, store, and commercially use them. Image rights remain the exclusive property of L’Abeille Blanche, even after the termination of this contract.

L’Abeille Blanche reserves the right to require the artist to remove any artwork or content deemed inappropriate to the shop’s values, such as homophobic or racist designs.

The artist authorizes the Association to advertise their work and mention them on its social media accounts and website.

After the trial period, L’Abeille Blanche commits to actively promoting the artist through at least one paid advertisement per month.

This advertisement may take various forms, including:

  • a post or video created by the artist, sponsored by L’Abeille Blanche; or

  • a post or video created directly by L’Abeille Blanche, featuring the artist individually or as part of the team, and shared on the shop’s official social media accounts.

The artist shall not make or share any negative or damaging statements about L’Abeille Blanche, including after the end of this contract.

Art. 9 – Rules and obligations

The artist agrees to:

  • Pay a 30% commission on each tattoo, deducted at payment.

  • Provide L’Abeille Blanche with a valid hygiene and safety certificate.

  • Create at least one (1) quality TikTok video per month, which the Association may choose to sponsor.

This contract will be automatically terminated if any of the above obligations are not met.

Art. 10 – Utilities

The artist may use the water and electricity required for their work without additional charges.

Art. 11 – Insurance (material and bodily injury)

The artist must have professional liability insurance covering bodily injury and material damage caused to themselves or others. The artist is responsible for insuring their own equipment and any materials they use or provide. It is the artist’s responsibility to take out an insurance policy.

Art. 12 – Disputes and liability

L’Abeille Blanche commits to selling only certified and authentic services. However, the Association cannot be held responsible for the quality or execution of services performed by third parties.

The artist remains solely responsible for their work. If any dispute arises that results in the cancellation of a sale made through L’Abeille Blanche, the commission already paid to the Association remains due in full as compensation for its services. Any refund or repair costs are entirely the responsibility of the artist.

Art. 13 – Legal disputes

In the event of a dispute, both parties shall first seek an amicable resolution through mediation by a mutually agreed mediator. If no agreement is reached, the courts of the Brussels judicial district shall have exclusive jurisdiction.

Art. 14 – Code of conduct

The artist agrees to follow the Code of Conduct established by L’Abeille Blanche ASBL. This code is displayed in the common area, and any updates will be announced to all artists.

Art. 15 – Trial period

A two (2) month trial period is established to allow L’Abeille Blanche to evaluate the collaboration with the artist. During this time, the Association will assess:

  • the artist’s work quality,

  • their proactivity (social media activity, creation of flash designs, number of appointments, etc.),

  • and their integration within the team and overall shop operations.

During the trial period, L’Abeille Blanche will not yet promote the artist on its official social media channels or through paid advertising.

At the end of this period, if the evaluation is satisfactory, L’Abeille Blanche will add the artist to its website, introduce them on its social media platforms, and begin active promotional efforts.
